The entire agreement is between Flying Hawk (“Service Provider”) and the consignee (“Customer”) who chooses to use service provider services. These Terms and Conditions of Transportation Services are proposed and prepared by the service provider to provide sufficient information for all customers. The Agreement shall become binding when accepted by the Customer either by acknowledgement or performance by the Service Provider. These Terms and Conditions shall apply to all shipments and services scheduled by Customer and may be amended from time to time by the Service provider, in its sole discretion. Any terms and conditions proposed by Customer which are additional to or inconsistent with the terms and conditions contained in the Agreement shall be void unless specifically agreed to by the Service Provider in writing.

Transportation documentations:

Each shipment under this Agreement shall be evidenced by one or more relevant documents, which may include:

  • Full sender & and receiver information: Full name, Address, Phone Number                

  • Declare the correct product type which not fall under the prohibited items          

  • Provide invoices or any purchase evidence of items                                   

  • Supply the exact quantity and product price in the package

If the Customer does not comply with all the documents required for shipment, or if the documents which the Customer submits are not appropriate or fabricated, the service provider has the right to reject any shipment at any time.  If a substitute form of Transportation Document is needed to complete the delivery of a shipment, the Service provider is not liable to the Customer or any other person or organization for any actions taken on behalf of the Customer under this provision and is not the service provider responsibly if the product is destroyed or inspected by the country's customs r                                    

Shipment of goods and contents:

The customer is the legally documented owner of all Goods tendered to the service provider and will comply with all applicable laws, rules, and regulations including, but not limited to, customs laws, import and export laws, dangerous materials laws/rules/regulations, and governmental regulation of any country to, from, through or over which the shipment may be carried. The customer will provide complete, accurate and timely information regarding each shipment. All items to be shipped will be completely and accurately marked to enable identification of the contents without opening any shipping or storage containers; The Customer will make every effort to accurately measure the dimensions and weights of all items and understand that the service provider rate depends upon the accuracy of this information.

Generally, some prohibited goods include:

  • Spray and perfumes with flammable substances

  • Any type of currency, Gold, diamond, silver, etc 

  • Weapons and ammunition

  • Drugs, Chemicals, medicines and other intoxicants

  • Live Animal or human parts

  • Radioactive materials

  • Laptops, bicycles or any items with batteries

  • Acidic substances

  • Other hazardous substances                                      

The service provider reserves the right to reject any request for shipping at its sole discretion. Without limitation, any shipment containing any item is considered a restricted article or hazardous material.

The Service Provider assumes no liability to the Customer or any other organization for any loss or expense due to the failure of the Customer to comply with this provision. Customer understands and agrees that, unless otherwise expressly agreed to by the service provider in the Agreement, Broker shall not acquire title to or assume the risk of loss for any of the Goods on behalf of Customer, and shall not, in the course of providing the services following the Agreement, acquire title to or assume the risk of loss for, or be deemed to have acquired title to or assumed the risk of loss for, the Customer’s Goods.

The customer indemnifies, defends, and holds the Service provider harmless against any liability, loss, damage, cost, or expense, including attorneys’ fees, claim, or penalty whatsoever arising from the service provider acting following the Customer’s instructions, from any breach by  Customer of any condition contained in this  Agreement.

Packaging condition:

All shipment packaging shall follow specific requirements as below:

  • Each shipment package does not exceed 20kg

  • Proper shockproof layer around fragile products

  • Seal the box and reinforce the corners

  • Watchful packaging for any high-value products if any content

  • The figure of kilograms will be rounded to a higher one. For instance, 0.4kg will become 0.5kg, 1.6kg will become 2kg         

  • There is an extra charge for oversize packages if exceed the standard size package (48*34*33)

In case customers desire any specific service for packaging, there is always a packaging service that can be done by the service provider for an extra charge.

Payment terms:

All charges are payable in € euros, due and payable within 3 days from the date of invoice by the service provider. All charges should be transferred to the service provider (Flying Hawk) Bank account via online banking or International Bank transfer (swift network) for overseas customers or in some cases payable by Cash (Only euro notes).

Limitations of Liability and Customer Duties:

Service Provider shall not be liable for any loss of or damage to any shipment, including as a result of the negligence or fault of Service Provider. Some of the general terms include:

  • The service provider is not responsible if the product is destroyed or inspected by the country's customs

  • The customer is fully responsible for the products sent and declares the correct value of the product

  • The Service Provider is not responsible for inspecting the product in your package, or opening any shipment packaging if it is faulty and confiscated

  • The service provider is not responsible if the product is damaged during transportation due to weather conditions and temperature changes

  • Service providers are not responsible if incorrect packaging results in damaged goods

  • Service providers are not responsible for goods damaged and lost due to force majeure, natural disasters, epidemics, etc.

  • The service provider shall keep customer shipping information confidential. However, in some cases, if the parcel contains prohibited goods or products that are not allowed to be sent according to regulations, the Service provider will provide all necessary pieces of information to a third-party organization to resolve this matter

Goods insurance damage claims :

No cargo insurance will be purchased or held by the service provider unless the service provider has agreed otherwise in writing with the Customer. The customer, at its expense, may purchase a shipper’s interest insurance policy, in which event the Service provider will act solely as a representative for the Customer, assisting the Customer with entering a separate contract for insurance between the Customer and the insurance carrier.

In case of damage claims the terms include:

  • compensate 100% if the customer buys goods insurance ( value of goods and shipping fee)

  • 50% of the shipping fee if the customer can prove that the goods are damaged, and the condition of the package is removed at the time of receipt by providing evidence (videos and photos) within 24 hours of receiving the goods. Lost or damaged goods must be matched with the provided information at the beginning of the shipment

  • In case the customer declares untruthfully, there will be a penalty fee of 30% of the total value of the package and the costs incurred if any in the process of solving the problem.         

No claims can be placed in the case of :

  • force majeure such as natural disasters, epidemics, riots, due to the nature of the goods and confiscation by the customs

  • manufacturer-specific issues

  • Error arising from the place of delivery to the company's warehouse in the Netherlands

  • Fragile goods which not well-packed

  • Lack of  requested information ( purchase invoice, declaration form)

  • Any goods that are sensitive to climate change temperature or humidity

Service Provider Responsibility:

The Service Provider agrees to offer the best possible service regarding shipping conditions and delivery times and inform and update customers. The Service Provider (Flying Hawk) has the right to revise or modify these terms and conditions at any time. If there is a decision to do so, the service provider will inform customers in advance time about when will be in place.
